1.0 OBTAINING A CERTIFIED TRUE COPY
1. Submission of application Letter addressed to the Director of Land Administration.
2. Application must be accompanied with the following documents;
i Police report
ii. Court affidavit
iii. Publication in 3 National dailies
2.0 NEW APPLICATION
1. Obtaining of new application forms from AGIS office or download from AGIS website;
2. Payment of necessary fees which is N100,000.00 for Commercial/Residential plots.
3. Present evidence of payment (teller) to AGIS Finance and obtain receipt.
4. Open File at New Application Desk with the following documents enclosed;
i) New Application Form properly filled,
ii) Tax Clearance Certificate for Individuals & Corporate bodies,
iii) CAC form C07,
iv) Photocopy of receipt,
v) Two Passport size photographs and
vi) Acceptable means of identification (driver’s license, National ID or International passport)
5) Obtain Acknowledgement Form for keeps.
3.0 CONDUCTING SEARCH & MAKING YOUR SEARCH EASY
After receiving complaints about delays being encountered by customers in the processing of their search applications, management went into the matter with a view to finding lasting solutions to the matter but discovered that majority of the cases result from errors in the applications filed by the customers.
Similarly, many customers usually begin to count their days even when technically, they have not commenced processing of their documents. In its commitment to improving its services and serve you better, we have outlined a step by step guide on how you can be sure that your search document and result will get to you on record time.
The Search process is a simple four-step process as follows:
STEP 1: SUBMISSION AND RECEIPTING
Applicant makes payment of Ten thousand (N10,000 for Private or Individual files) or Twenty Thousand Naira (N20,000 for Commercial or Organizational files) only, into AGIS designated Banks (Zenith, First Bank, GTBank, SunTrust, Heritage Bank, Ecobank, Fidelity & UBA) and thereafter proceed to Finance desk for receipting.
STEP 2: SUBMISSION OF APPLICATION
All applications for search should be addressed to Director of Land Administration, and must be submitted at the front desk with evidence of payment.
STEP 3: PRESENTATION OF ORIGINAL TITLE DOCUMENT FOR SIGHTING
When the mail gets to the desk officer, the applicant is expected to forward the Original Title Document for sighting, along with a valid identification (i.e. international passport; national ID card; and or, driver’s license).
STEP 4: SUBMISSION OF YOUR APPLICATION
The application should be submitted with AGIS receipt attached at the legal search desk.
BE CAREFUL TO:
a) Start early in the day. Customer desks begin to attend to customers by 9am and end 3pm each working day
b) Write your application properly endorsing it with your signature, name and phone number
c) Bring original titles for sighting by Desk Officer
d) Desk Officer will write on your application “original sighted and date of sighting”
e) Once that is done, process your receipt
f) After receipt is processed, get receipt to be sighted by the finance officer.(Ensure triplicate receipt has been signed and take same to the Revenue Officer for countersigning)
g) Staple receipt to application to conduct search
h) Now submit application.
IMPORTANT NOTES
i) Issues not turned in early enough are rolled over the next day. So, commence your processing early in the day so as to gain more ground before the close of customer desk
ii) Your search processing period starts counting from the day you submit your search document with receipt attached
iii) Search result is usually ready within 24 hours or latest three days
iv) If your result is not out within this period call +2348033311934
v) Diligent customers make hay while the sun shines.
COMMON ERRORS THAT DELAY YOUR SEARCH RESULTS:
i) Coming late in the day and getting stuck midway before close of office
ii) Customer assigning the wrong plot number on their application forms/letters
iii) Forgetting to sign your application
iv) Forgetting to write your name on the applications
v) Using the wrong particulars for the right applications
vi) Not including phone numbers under you name with which to contact you when these anomalies are discovered
vii) Not double-checking your document to make sure that you have fully complied with the procedure
viii) Not following up to check if there is a message for you
ix) Appearing at the collection desk days after, only to discover you had not even started.
WHAT AGIS WILL DO FOR YOU
i) Call you to inform you if/when there is any problem with your document if you have a phone number
ii) Call you to inform you your document is ready if collection is delayed
iii) Flag your document to indicate the trouble with it
iv) Committed to serve you better.
4.0 REQUIREMENT FOR REGISTRATION OF POWER OF ATTORNEY
i) FOR INDIVIDUAL/PRIVATE
a) Application to register Power of Attorney from Donor
b) Original and photocopies of Title documents for sighting
c) Bill & evidence (receipts) of payment of;
i) Statutory Right of Occupancy (RofO) fees
ii) Ground rent over the years
d) Original and counterpart copies of the executed documents.
e) Valid means of identification of both the Donor and Donee (e.g. Coloured copy of International passport/driver’s license/National ID card of the authorized signatories.)
ii) FOR CORPORATE ORGANIZATION
a) Application to register, signed & sealed by two (2) Directors on the company letter head.
b) Board resolution to the above effect (from both parties).
c) Certificate of incorporation from CAC.
d) Recent Certified True Copy of form C07 from CAC (3 months latest)
e) Copy of valid means of identification of both the donor and done (e.g. International passport/driver’s license/national ID card of the
authorized signatories).
f) Recent certified True Copy of form C02 for (business name)
g) Power of attorney must be executed by two (2) directors of the company with the company seal.
iii) FOR BUSINESS NAME
a) Form 2, (Business Name)
b) Power of Attorney must be executed by 2 Directors
c) Copy of certificate of incorporation
iv) POWER OF ATTORNEY PROCESSING FEES;
Payment through AGIS designated banks
a) N102,000.00 in favour of AGIS
b) N2,000.00 for any extra copy.
NOTE: The officer in charge reserves the right to request for additional documents, information, and/or make further confirmations if necessary.
Applicants are advised to comply fully with the above, to prevent delays in approval and processing, please.
5.0 DEED OF ASSIGNMENT/GIFT
a) Application to (Director of Land)
b) Payment of all outstanding bills
c) The subject plot must be developed
d) Submit consent letter, attaching copy of Certificate of Occupancy
e) Payment of 8% of the value of property
i) REQUIREMENTS FOR DEED OF SUBLEASE
The same requirements for Deed of Assignment apply to Deed of Sublease for both individual and Limited Liability Company.
a) After the valuation report gets approval from the Honourable Minister of FCT.
b) A conveyance letter is prepared stating the following fees payable;
– 2% of the consideration
– Consent fee N10,000.00
– Processing fee N10,000.00
– Counterpart copy N2,000.00 each
NOTE: That the consideration must be reasonable for it to be forwarded for Minister’s approval.
ii) IN ADDITION FOR LIMITED LIABILITY COMPANY
a) Form C07 (Particulars of Directors)
b) Certificates of Incorporation
c) Photocopy of Directors ID
d) ID of Collector
6.0 CONSENT OF THE HONOURABLE MINISTER TO A LEGAL MORTGAGE
All interested applications for the registration of legal mortgage over land title within FCC are requested to submit the under listed documents
alongside their application letter:
a) Consent letter from the mortgage or
b) Board resolution (if Applicable)
c) Photocopy of brief from bank instructing on the perfection of the transaction
d) Copy of recent tax clearance.
e) Payment receipts of ground rents for previous and current year.
i) FEES CHARGEABLE UPON APPROVAL
a) Registration fees: 1% of consideration
b) Consent fee: N10,000.00
c) Processing fee: N10,000.00
d) Counterpart copy: N2,000.00
ii) REQUIREMENTS FOR QUARRY LEASE
a) Opening of Land application file
b) Letter of introduction from mining cadastre officer stating the lease number and size of the plot (Cadastre Unit) and location
c) Feasibility report/environmental impact analysis
d) Require clearance from the Department of Urban & Regional Planning before processing.
7.0 REQUIREMENTS FOR COLLECTION OF RIGHT OF OCCUPANCY/LAND ALLOCATION LETTERS (R-OF-O)
A) FOR INDIVIDUALS
1) The original Land Application Acknowledgment.
2) Genuine and verifiable means of Identification of the collector (originals) which must be from the following:
a) Valid International/Travel Passport (preferred)
b) Valid National Identity Card
c) Valid Permanent Voters Card (PVC)
d) Valid National Driver’s License (NDL)
e) Valid Work Identity Card
(In some cases, more than one means of Identification could be required)
3) Direct image capture (Photograph) of Collector. If collecting by Proxy, the above (2) shall also apply:
4) Dated Letter of Authority.
(The letter must be original and signed by the original allottee/owner. Original Photo I.D. (preferably international/Travel Passport) of the person signing the Authority Letter should be enclosed for sighting).
Note: Persons really desirous of collecting Rights of Occupancy whether in person or by proxy are advised to comply fully with the above, to prevent delays in collection, or outright refusal to collect.
B) FOR CORPORATE ORGANISATIONS
1) The original Land Application Acknowledgment.
2) Genuine and verifiable means of Identification of the collector (originals) which must be from the following:
a) Valid International/Travel Passport (preferred)
b) Valid National Identity Card
c) Valid Permanent Voters Card (PVC)
d) Valid National Driver’s License (NDL)
e) Valid Work Identity Card
(In some cases, more than one means of Identification could be required)
3) Direct image capture (Photograph) of Collector.
4) Certificate of Incorporation and Form CAC 07 (Particulars of Directors).
5) Dated Letter of Authority on the company’s official letter-headed Paper.
a) The letter must be signed by two serving directors of the company with their full names indicated.
b) In – exceptional cases, a letter from – duly authorized senior officer(s) of the company could be accepted.
c) In all cases, original Photo I.D. (preferably International Passport) of the person(s) signing the Authority Letter should be enclosed for sighting.)
NOTE: The R-of-0 Release Officer reserves the right to request for additional documents, information, and/or make further confirmations if necessary. Organisations or individuals really desirous of collecting Rights of Occupancy are advised to comply fully with the above, to prevent delays in collection, or outright refusal to collect.
8.0 CERTIFICATE OF OCCUPANCY (C-OF-O)
a) Original acknowledgment/Right of Occupancy (R of 0)
b) Payment of ground rent
c) Payment of C of 0 bill where necessary
d) Payment of Title Regularization bill where necessary
e) If collection by proxy, letter of authority from the owner and owners ID (International Passport/National ID), Power of Attorney (in case of transaction)
1) FOR LIMITED LIABILITY COMPANY
a) Form C07 (particulars of directors)
b) Certificates of Incorporation
c) Photocopy of directors ID
d) ID of collector
2) FOR SALES OF FEDERAL GOVERNMENT HOUSES
a) Clearance letter from Ad-hoc Committee on sales of FGH
b) Original offer letter & photocopy
c) Collection by proxy: Authority Letter and means of identification of the owner & collector
d) Outstanding Grand rent over the years.
9.0 APPLICATION FOR LATE RE-CERTIFICATION OF FCC TITLES
Application letter to the Director of land for late re-certification with the following documents;
a) Original title document for perusal (Individual/Organisation)
b) Completed re-certification form
c) Payment of N150,000 for late re-certification fee
d) Submission of all the above documents.
Note: Update & acknowledgement will be issued to applicants on presentation of valid ID (International Passport of Voters Card).
10.0 TITLE REGULARIZATION
a) Application for valuation of the property in question by Estate Division of Land Department
b) Obtaining Ministerial approval for Valuation
c) Re-Issue and payment of bills
11.0 AREA COUNCIL REGULARISATION EXERCISE
a) Fill regularization form (obtainable at AGIS)
b) Payment of regularization fee (N5,000.00) at the designated banks (same fee for commercial & residential application)
c) Submission of completed form along with original copies of R-of-O or C-of-O, Company Registration paper (Form C07 and certificate of incorporation) for commercial application.
d) Data capture of documents submitted
e) Collection of regularization acknowledgement.
12.0 MASS HOUSING
Refer to Mass Housing guidelines issued by the Department of mass Housing of the Federal Capital Development Authority (FCDA)
13.0 AFFORDABLE HOUSING
Refer to affordable Housing guidelines issued by the Satellite Town Development Department (STDD).
